I’ve been charged with a Criminal Offence. What Information Is Disclosed to the Public?

If you have been charged with a criminal offence you may be concerned if this information is available to the public eye. Here is what you need to know.
Criminal Court Proceedings Are Open in Queensland
If you have faced the courts once before, you may already know this to be true - persons unaffiliated with the case are allowed to observe court proceedings (excluding those concerning domestic violence). This includes media reporters, students, and other members of the general public.
Details of who will be attending court are accessible to the public in Queensland. This is an online format that is updated daily, displaying those who will be before the court for criminal and civil matters within the next day. Those affiliated with the media can view this information as can the general public. This is referred to as the ‘daily law lists’.
The Queensland Government-established daily law lists do not retain this daily information. In other words, the previous history of court attendance cannot be sourced. Unauthorised third-party websites may have the means to do this.
Be Aware Of The Difference
To note importance, this accessible information is made with reference only to charges, not official convictions, acquittals or withdrawals. This does not apply to sexual offences in Queensland. Media is restricted until after a committal hearing where the accused is committed for trial.
The Power of the Judge
Non-publication orders can be made by the Judge. Non-publication orders are orders that restrict the information about the case being made publicly available.
This order will not allow for any media publications to publish information regarding the case. This decision is made ultimately by the Judge, and may not be granted.
